Wing Mobile App Privacy Policy

Introduction
Wisht LLC d/b/a Wing (“Company” or “We”) respects your privacy and is committed to protecting it through its compliance with this policy. This policy describes:
- The types of information we may collect or that you may provide when you download, install, register with, access or use Wing (the “App”).
- Our practices for collecting, using, maintaining, protecting, and disclosing that information.
This policy applies only to information we collect in or through this App and in email, text, and other electronic communications sent through or in connection with this App. This policy does not apply to information that we collect offline or on any other Company apps or websites, or that you provide to or is collected by any third party.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, install, register with, or use this App. By downloading, installing, registering with, or using this App, you agree to this privacy policy. This policy may change from time to time. Your continued use of this App after we revise this policy means you accept those changes, so please check the policy periodically for updates.
Children Under the Age of 18
The App is not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at support@wingapp.us.
Information We Collect and How We Collect It
We collect information from and about users of our App:
- Directly from you when you provide it to us.
- Automatically when you use the App.
Information You Provide to Us
When you download, install, register with, or use this App, we may ask you to provide information by which you may be personally identified, such as name, postal address, email address, telephone number, or any other identifier by which you may be contacted online or offline (“personal information”); and information that is about you but individually does not identify you, such as preferred restaurants or cuisines, dietary preferences, allergy information, and restaurant reviews. This information includes information you provide by filling in forms in the App, records of your correspondence if you contact us, your responses to surveys, details of transactions you carry out through the App, and your search queries on the App.
Automatic Information Collection and Tracking
When you download, access, and use the App, it may use technology to automatically collect:
- Usage Details. Details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use.
- Device Information. Information about your mobile device and internet connection, including the device’s unique identifier, IP address, operating system, browser type, and mobile network information.
- Stored Information and Files. Metadata and other information associated with files stored on your device, such as photographs, audio and video clips, personal contacts, and address book information.
- Location Information. Real-time information about the location of your device.
If you do not want us to collect this information, do not download the App or you should delete the App from your device.
Information Collection and Tracking Technologies
The technologies we use for automatic information collection may include cookies (or mobile cookies), which are small files placed on your smartphone, and web beacons, which are small electronic files that permit the Company to count users who have visited certain pages and for other related app statistics.
Third-Party Information Collection
When you use the App or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include restaurants and other dining establishments, our service providers, advertisers and ad networks, analytics companies, your mobile device manufacturer, and your mobile service provider. We do not control these third parties’ tracking technologies or how they may be used.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information, to provide you with the App and its contents; to fulfill any other purpose for which you provide it; to give you notices about your account; to carry out our obligations and enforce our rights; and to notify you about changes to the App. The usage information we collect helps us improve our App and deliver a better, more personalized experience. We use location information we collect to identify or locate restaurants near your location.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction. We may disclose personal information that we collect or you provide to our subsidiaries and affiliates; to contractors, service providers, and other third parties bound by contractual obligations of confidentiality; to a buyer or successor in the event of a merger or sale of assets; to fulfill the purpose for which you provide it; with your consent; to comply with any court order, law, or legal process; and if we believe disclosure is necessary to protect the rights, property, or safety of Wing, our customers, or others.
Your Choices About Our Collection, Use, and Disclosure
We strive to provide you with choices regarding the personal information you provide to us. You can set your browser or device to refuse cookies and to control location sharing, though some parts of the App may then become inaccessible or not function properly. You can opt out of promotional and targeted-advertising uses of your information by visiting www.wingapp.us, by adjusting your user preferences in your account profile, or by emailing your request to support@wingapp.us.
Accessing and Correcting Your Personal Information
You can review and change your personal information by logging into the App and visiting your account profile page. You may also email us at support@wingapp.us to request access to, correct, or delete any personal information you have provided to us. We cannot delete your personal information except by also deleting your user account.
Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on secure servers behind firewalls, and any payment transactions will be encrypted. The safety and security of your information also depends on you; where you have a password for access to certain parts of our App, you are responsible for keeping it confidential. Unfortunately, the transmission of information via the internet is not completely secure, and any transmission of personal information is at your own risk.
Changes to Our Privacy Policy
We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on this page and notify you. The date the privacy policy was last revised is identified at the top of the page.

Privacy Policy for California Residents

This Privacy Policy for California Residents supplements the information contained in Wing’s Mobile Application Privacy Policy and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA), and any terms defined in the CCPA have the same meaning when used in this Policy.
Information We Collect
We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”). Personal information does not include publicly available information from government records, deidentified or aggregated consumer information, or information excluded from the CCPA’s scope (such as information covered by HIPAA, the FCRA, the GLBA, or the Driver’s Privacy Protection Act). We collect the following categories of personal information:
- A. Identifiers. Real name, alias, postal address, unique personal identifier, online identifier, IP address, email address, or account name.
- B. California Customer Records categories. Name, signature, address, telephone number, credit or debit card number.
- C. Protected classification characteristics. Age, race, color, ancestry, national origin, citizenship, religion or creed, and sex.
- D. Commercial/spending information. Records of products or services purchased, obtained, or considered, and other purchasing histories or tendencies.
- E. Internet or other network activity. Browsing history, search history, and information on interaction with a website, application, or advertisement.
- F. Geolocation data. Physical location or movements.
- G. Sensory data. Audio, electronic, visual, or similar information.
- H. Inferences. A profile reflecting a person’s preferences, characteristics, predispositions, behavior, and attitudes.
- I. Dining/dietary information. Preferred restaurants or cuisines, dietary preferences, allergen information, and restaurant reviews.
We obtain these categories of personal information directly from you (for example, from forms you complete or products and services you purchase) and indirectly from you (for example, from observing your actions on our App or Website).
Use of Personal Information
We may use, sell, or disclose the personal information we collect to fulfill the reason you provided it; to provide, support, personalize, and develop our App, Website, products, and services; to create, maintain, customize, and secure your account; to process your transactions and prevent fraud; to provide support and respond to your inquiries; to personalize your experience and deliver relevant content and offerings; to maintain the safety and security of our services; for testing, research, and product development; to respond to law enforcement and as required by law; and to evaluate or conduct a merger, divestiture, or other sale or transfer of assets.
Sharing Personal Information
We may share your personal information by disclosing it to a third party for a business purpose, only under written contracts that require the recipient to keep the information confidential and use it only to perform the contract. In the preceding twelve (12) months, Company has not disclosed personal information for a business purpose. We may also share your personal information by selling it to third parties, subject to your right to opt out of those sales. Our personal information sales do not include information about individuals we know are under age 18.
Your Rights and Choices
Right to Know and Data Portability
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months, including the categories of personal information we collected, the categories of sources, our business or commercial purpose, the categories of third parties with whom we share it, and the specific pieces of personal information we collected about you.
Right to Delete
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive your request and confirm your identity, we will review whether an exception applies and, if not, delete (or deidentify) your personal information and direct our service providers to do the same.
Exercising Your Rights
To exercise your rights to know or delete, please submit a request by emailing us at support@wingapp.us or by visiting www.wingapp.us. Only you, or a person authorized to act on your behalf, may make a request related to your personal information. We will confirm receipt of your request within ten (10) business days and endeavor to respond substantively within forty-five (45) days.
Personal Information Sales Opt-Out and Opt-In Rights
If you are age 16 or older, you have the right to direct us not to sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we know are less than 16 years old. To exercise the right to opt-out, you (or your authorized representative) may submit a request by emailing support@wingapp.us.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not deny you goods or services, charge you different prices or rates, provide you a different level or quality of goods or services, or suggest that you may receive a different price or quality for exercising your rights.
